acting as the Controller of personal data, hereby informs you, as a user of the Company’s website, about the collection of personal data described below and the principles governing the protection of privacy and personal data by our Company, which are maintained in accordance with Act No. 110/2019 Coll., on Personal Data Processing (hereinafter referred to as the “Act”), and Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, the General Data Protection Regulation (hereinafter referred to as the “Regulation”).

2. For what purposes and in what manner our Company will process your personal data;

Processing of Children’s Personal Data

Our website is not intended for persons under the age of 18. We do not process personal data of persons under the age of 18, except in cases where such persons are represented in legal proceedings by a representative appointed by law or by a court decision.

 

Scope of Personal Data Processing

If you contact us for the purpose of purchasing goods and/or obtaining services from our Company, you will be asked to provide information necessary for carrying out the transaction and delivering the subject matter of the transaction and/or service. Such information may include in particular:

a) Your first name and surname, title, or business name,

c) residential address, registered office address, or delivery address,

d) date of birth, personal identification number,

e) Company ID and Tax ID number, other accounting and invoicing information,

f) bank account number,

e) telephone number,

f) email address.

 

Purpose of Processing

We will use the information you provide to contact you and provide the information you have requested, or for the purposes of preparing contractual arrangements and fulfilling our obligations arising from commercial contracts for supplies and/or services, including complaint procedures and the handling of rights arising from liability for defects in sold goods.

All personal data is processed lawfully and transparently, and only data that is adequate, relevant and necessary in relation to the purpose of processing is requested.

Your first name, surname and email address may also be used, solely with your explicit, voluntary and written consent, to send you so-called Commercial Communications, i.e. to inform you about promotions and/or services offered by our Company that we believe may be of interest to you. Granting consent to the use of personal data for sending Commercial Communications is not necessary and is not a condition for entering into a commercial contract.

The provision of personal data for the purposes of fulfilling contracts for the provision of services and/or supplies, as well as the provision of personal data for the purpose of responding to your enquiries or providing information requested by you, constitutes a contractual requirement, and failure to provide such data may result in the inability to prepare the relevant contractual arrangements and conclude the corresponding contracts and/or to respond to your enquiries.

You may refuse the processing of your personal data for the purpose of sending Commercial Communications at any time, without affecting any other contractual relationship between you and our Company. Simply send us an email with the relevant request to the contact email address stated above or to another address from which you received a Commercial Communication from our Company.

 

Who Has Access to Your Personal Data

Your personal data will be processed by our Company as the Controller, and our Company will also prepare the relevant contractual arrangements. For the purposes stated above, the Company may transfer your personal data to its subcontractors so that they may process such data on behalf of the Company.

Personal data may be transferred or made available for processing to subcontractors providing relevant services to our Company (IT and website administration, legal services, tax advisory services, auditing services, accounting services), hereinafter referred to as the “Processor”; see the list of Processors and Business Partners published on our Company’s website or provided to you upon request. Business partners and subcontractors cooperating with our Company may change over time; therefore, we recommend checking the current list published on the Company’s website.

Processors are obliged to comply with both the Regulation and the Act and are subject to the same obligations regarding the protection of personal data.

 

Period of Personal Data Processing

The Company will process your personal data for the period during which it provides services to you or fulfils its contractual obligations, including warranties relating to the provided performance, and subsequently for the period necessary to comply with statutory archiving obligations under applicable legislation, such as accounting legislation, legislation governing archiving and records management, or value added tax legislation, for a maximum period of 20 years.

 

Your Rights Arising from the Processing of Personal Data

In relation to the processing of your personal data carried out by our Company, you have in particular the following rights:

a) the right of access to personal data;

b) the right to rectification;

c) the right to erasure (“right to be forgotten”);

d) the right to restriction of processing;

e) the right to object to processing; and

f) the right to lodge a complaint regarding the processing of personal data.

You may exercise any of your rights by contacting us at the Company’s email address stated above.

You may lodge a complaint with the supervisory authority, which is the Office for Personal Data Protection of the Czech Republic.

 

Right of Access means that you may at any time request confirmation from our Company as to whether personal data concerning you is being processed. If such data is being processed, you have the right to obtain information about the purposes of processing, the scope of the data processed, the recipients to whom the data is disclosed, the period for which our Company will process the data, whether you have the right to rectification, erasure, restriction of processing or to object to processing, the source from which the personal data was obtained, and whether automated decision-making, including profiling, takes place on the basis of the processing of your personal data. You also have the right to obtain a copy of your personal data. The first copy will be provided free of charge; for additional copies, our Company may charge an administrative fee of CZK 50.

Right to Rectification means that you may at any time request our Company to correct or supplement your personal data if it is inaccurate or incomplete.

Right to Erasure means that the Company is obliged to erase your personal data if (i) the personal data is no longer necessary for the purposes for which it was collected or otherwise processed, (ii) the processing is unlawful, (iii) you object to the processing and there are no overriding legitimate grounds for the processing, or (iv) the Company is required to do so by law.

Right to Restriction of Processing means that, until our Company resolves any disputed issues concerning the processing of your personal data, it must restrict the processing of your personal data so that such data may only be stored and, where applicable, used for the establishment, exercise or defence of legal claims.

Right to Object means that you may object to the processing of your personal data where our Company processes such data for direct marketing purposes or on the basis of a legitimate interest. If you object to processing for direct marketing purposes, your personal data will no longer be processed for such purposes.
